Terms of Service

By creating an account, accessing, or using the Whispertise™ platform, you agree to be bound by these Terms of Service. If you do not agree to these Terms, you may not access or use any Whispertise™ services.

Whispertise™ is a word-of-mouth marketing platform enabling businesses to run verified referral campaigns and Whisperers™ to earn performance commissions through trust-based introductions and referrals.

You must provide accurate, current, and complete information during registration. You are solely responsible for safeguarding your credentials and account security. You agree to immediately notify us at legal@whispertise.com of any unauthorized access or security breach.

To qualify and participate in campaigns, Whisperers™ must maintain: (a) TrustScore™ of 80 or above; (b) Satisfaction rating of 75% or above; (c) Active membership for at least 30 days. Quality and eligibility criteria are enforced continuously by automated server-side verification systems.

AI credits are one-time purchases and do not expire. Whisperer™ commissions are disbursed within 48 hours following conversion confirmation (subsequent to the mandatory 14-day verification window). Business subscription credits are granted on a monthly basis and do not roll over. Whisperer™ campaign entry credits never expire. All attributed conversions are subject to a 14-day reversal window before commission is definitively confirmed.

Users may not engage in spamming, harassment, intellectual property infringement, bot activity, artificial traffic generation, multi-accounting, fraud, or technical circumvention of Whispertise™ security systems. Violations will result in immediate termination without refund.

Platform software, algorithms, designs, logos, and the Whispertise™ trademark are exclusively owned by Whispertise LLC. Nothing in these Terms grants you ownership of Whispertise™ intellectual property.

Your privacy is critical to us. Collection, processing, and storage of personal information is governed strictly by our Privacy Policy, which is incorporated into these Terms by reference.

The Whispertise™ platform is provided on an "AS-IS" and "AS-AVAILABLE" basis without warranties of any kind. To the maximum extent permitted by applicable law, Whispertise LLC and its affiliates shall not be liable for indirect, incidental, special, punitive, or consequential damages.

Whispertise™ is owned and operated by Whispertise LLC, a limited liability company duly registered in the State of Arizona, United States (the "Company"). All formal agreements, contractual obligations, and payments are strictly with Whispertise LLC.

These Terms are governed by and construed in accordance with the laws of the State of Arizona, United States, without regard to conflict-of-law principles. Any dispute, claim, or controversy arising out of or relating to these Terms shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in Phoenix, Arizona, conducted in English. Each party retains the right to seek injunctive relief in a court of competent jurisdiction or proceed in small claims court for qualified disputes.

You and Whispertise LLC agree that any proceedings to resolve disputes will be conducted solely on an individual basis. Class actions, collective actions, private attorney general actions, and representative proceedings are expressly waived to the maximum extent permitted by law.

Whisperers™ operate solely as independent contractors and are not employees, agents, or partners of Whispertise™ or Whispertise LLC. You are solely responsible for determining, reporting, and remitting any applicable income tax, sales tax, or self-employment tax on commissions received. Whispertise™ will issue required tax documentation (such as Form 1099-NEC) in compliance with US and local laws.

Whisperers™ must include a conspicuous, clear paid referral disclosure in every communication or introduction — for example: "This is a paid referral introduction. I may earn a commission if you make a purchase." Failure to disclose commercial relationships violates these Terms as well as applicable advertising regulations including the FTC Endorsement Guides and EU Consumer Protection Directives. Campaign content must never contain misleading, deceptive, or unsubstantiated claims.

Commissions are attributed to the last verified Whisperer™ referral link clicked prior to conversion, subject to the campaign attribution window. Self-referrals — purchasing through your own referral link or coordinating simulated purchases — are strictly prohibited and will trigger automatic commission forfeiture and account termination. Conversions require a 14-day hold to protect against chargebacks, cancellations, or fraudulent transactions.

All campaigns are reviewed prior to activation. Businesses warrant the truthfulness and accuracy of all product claims. Whispertise™ reserves the right to reject or terminate campaigns at its sole discretion, including restricted categories such as adult content, weapons, unauthorized pharmaceuticals, unverified financial schemes, gambling, and items prohibited under local jurisdiction.

Whispertise™ reserves the right to require identity verification (KYC) and sanctions screening before disbursing payouts. Accounts under investigation for suspicious activities may have payouts temporarily paused pending compliance review. For questions, contact legal@whispertise.com.

Payouts are available to Whisperers™ residing in supported territories, subject to minimum thresholds and identity verification. Balances remaining unclaimed for twenty-four (24) consecutive months without account activity may be handled in accordance with statutory unclaimed-property and escheatment laws.

We reserve the right to revise or update these Terms as the platform develops. Continued access or use of Whispertise™ following published changes indicates your acceptance of the amended Terms.
